"Serving as a Fiduciary: Trick or Treat?"


Clients, family, and friends often ask their estate planning professionals to serve as fiduciary of their trusts and estates.  While it’s flattering to be asked, serving as a fiduciary carries significant risks.  Ms. Kaufman will explore the hidden dangers of acting as a trustee or executor, from personal liability and professional conflicts to getting entangled in family disputes and litigation. With real-world cautionary tales and ethical analysis, this presentation will highlight why even well-intentioned advisers may find themselves in a professional nightmare when they take on fiduciary roles.

Beth Shapiro Kaufman has decades of experience providing advice on sophisticated estate planning issues with an eye toward tax efficiency. She advises high net-worth individuals and family offices on estate, gift, and generation-skipping transfer taxes, as well as advocating on their behalf before the IRS in ruling requests, audits, and other tax controversies. Clients appreciate her deep knowledge and clear explanations. Beth draws upon her experience serving in the U.S. Treasury Department's Office of Tax Policy— first, as Attorney Advisor, and then as Associate Tax Legislative Counsel—where she had principal responsibility for all tax policy matters affecting trusts and estates. She was the primary Treasury representative involved in legislative and regulatory developments affecting estate, gift, and generation-skipping transfer tax, as well as the income taxation of trusts and estates. Beth is a member of the Adjunct Faculty at Georgetown University Law Center, where she teaches LLM-level classes on the Generation-Skipping Transfer Tax. She formerly clerked for Chief Judge Spottswood W. Robinson, III of the U.S. Court of Appeals, District of Columbia Circuit.
